McClain attorneys seek deal

Prosecutors and defense attorneys for Rolando McClain were working to reach a settlement Thursday on traffic violations in which Decatur police cited the NFL football player over the past two years.

The Oakland Raiders linebacker won’t face trial Monday on reckless driving and no proof of insurance charges from a May 19, 2011, traffic stop. Morgan County Circuit Court Judge Steven E. Haddock had not reset the trial date.

City Prosecutor Emily Baggett said any settlement is likely to include resolution of charges in Decatur Municipal Court of giving a false name to law enforcement and violating window-tint limitations from a Jan. 8 traffic stop.

Police said officers charged McClain, a Decatur native, with giving a false name after he allegedly signed the ticket for window tint “(expletive) y’all,” and then insisted that was his name.

Several lawyers said that charge was unlikely to hold up in court.

McClain and his attorney, Harvey Steinberg of Denver, stipulated to the reckless driving and insurance charges in municipal court May 18, 2012. That same day McClain was convicted on charges from November 2011 of third-degree assault, menacing, reckless endangerment and wrongful discharge of a firearm. Municipal Judge Bill Cook sentenced the former Decatur High and University of Alabama standout to 180 days in jail and $2,000 in fines, but McClain appealed the case to circuit court.

The charges from November 2011 were later dropped.

Neither McClain nor Steinberg appeared at the courthouse Thursday, when McClain was scheduled for the afternoon settlement docket. McClain recently purchased a home in Madison.
